  • Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Placing Orders for Goods

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

Your Information

If You wish to place an Order for Goods available on the Service, You will be asked to supply certain information relevant to Your Order. This includes, without limitation, Your name, Your email, Your phone number, Your billing address, and Your shipping information. Please note that sensitive payment details (such as credit card numbers or expiration dates) are securely processed directly by our designated payment gateway, Razorpay, and are not stored by Us.

You represent and warrant that: (i) You have the legal right to use any payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, You grant us the right to provide the necessary details to our payment processing third parties (Razorpay) and shipping partners (Shiprocket) for purposes of facilitating the completion of Your Order.

Guest Checkout and Account Creation

You have the flexibility to place an Order as a guest without creating a registered account. Alternatively, you may choose to create an account during the checkout process; if you do so, your account will be associated with the billing email address provided. Existing users have the option to log in to their account to proceed with an order.

Your Order Cancellation Rights & Returns Policy

Any Goods you purchase can only be returned in accordance with these Terms and Conditions and Our separate, comprehensive Returns and Refund Policy. We strongly encourage You to review Our dedicated Returns and Refund Policy page to understand your full rights and the detailed process for returns and refunds.

To initiate a return or cancellation, You must contact our support team within 7 calendar days from the date of delivery of the Goods. Goods must be returned in the exact condition as You received them: unused, unassembled (where applicable), undamaged, and in their original, unopened packaging, including all instructions, documents, and accessories. Goods that are damaged, show signs of use, or are not in their original condition (e.g., tires show dirt, components are scuffed, original tags or protective coverings are missing) will not be eligible for a refund. You should therefore take reasonable care of the purchased Goods while they are in Your possession.

Non-Returnable Goods:
You will generally not have any right to cancel an Order for, or return, the supply of the following Goods:

  • Goods made to Your specifications or clearly personalized (e.g., customized cycles).
  • Goods that are not suitable for return due to health protection or hygiene reasons and were unsealed or used after delivery (e.g., certain cycling apparel or accessories once opened/worn).
  • Consumable items, such as tire sealants, chain lubricants, or similar products, once their original seal is broken or they have been used.
  • Goods which are, after delivery, according to their nature, inseparably mixed with other items (e.g., a component that has been permanently installed onto a cycle).

Return Shipping Costs: The responsibility for return shipping costs is conditional and depends on the reason for the return. Full details regarding who bears the return shipping cost will be outlined in our comprehensive Returns and Refund Policy page.

We will process Your reimbursement no later than 14 days from the day on which We receive the returned Goods. We will use the same means of payment as You used for the Order, and You will not incur any processing fees from Us for such reimbursement (any applicable return shipping costs may be deducted or borne by You as per our Returns Policy).

Availability, Errors and Inaccuracies

We are constantly updating Our offerings of Goods and Services on the Service. The Goods and Services available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods and Services on the Service and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Prices Policy

The Company reserves the right to revise its prices for Goods and Services at any time prior to accepting an Order.

All prices displayed on the Service are inclusive of Goods and Services Tax (GST) as applicable in India. Please note that the displayed product prices do not include shipping or delivery charges. Applicable shipping charges will be calculated and clearly displayed to You at the checkout page before You confirm Your Order.

In rare cases, the prices quoted may be revised by the Company subsequent to accepting an Order. This will only occur in the event of unforeseen circumstances affecting delivery or costs caused by government action, significant variation in customs duties, increased shipping charges, higher foreign exchange costs, or any other matter beyond the reasonable control of the Company. In such an event, You will be promptly notified and will have the right to cancel Your Order if You do not agree to the revised price without any penalty.

Upon successful order completion and payment, an invoice detailing Your purchase, including GST breakdown, will be provided to You via email and included within Your courier package.

Payments

All Goods purchased are subject to a one-time payment, processed at the time of order placement.

1. Online Payments:

We accept online payments exclusively through Razorpay. Your payment will be securely processed via Razorpay’s platform, which supports various payment methods including major credit cards, debit cards, UPI, and net banking, as offered by Razorpay. By choosing an online payment method, you agree to Razorpay’s terms and conditions.

2. Cash on Delivery (COD):

Cash on Delivery (COD) is available as a payment option only for specific orders and is subject to strict conditions:

Pincode Serviceability: COD is offered exclusively to a pre-defined list of serviceable pincodes within India. The availability of this option for your delivery address will be confirmed to you at the time of checkout.

Shipping Partner Allowance: The acceptance and processing of COD orders are entirely contingent on the serviceability and terms set forth by our shipping partner, Shiprocket, for your specific location and the value of your order. We reserve the right to refuse COD for any order that does not meet these criteria.

3. Payment Authorization:

All payments, whether online via Razorpay or through Cash on Delivery, are subject to validation checks and authorization by your card issuer, bank, or relevant payment service provider. In the event that we do not receive the required authorization or confirmation of payment for an online transaction, or if a COD order fails our internal validation or our shipping partner’s serviceability checks, we reserve the right to cancel your order without liability for any delay or non-delivery.

User Accounts

When You create an account with Us, whether directly through Our Service (using your email and chosen password) or by linking a Third-Party Social Media Service (such as Facebook or Google through Nextend Social Login), You are required to provide information that is accurate, complete, and current at all times. Failure to maintain accurate, complete, and current information constitutes a breach of these Terms, which may result in immediate termination or suspension of Your account on Our Service.

You are solely responsible for safeguarding the confidentiality of Your account password (for directly created accounts) or the credentials used to access Your Third-Party Social Media Service. You are fully responsible for any and all activities or actions that occur under Your password, whether Your password is with Our Service or a Third-Party Social Media Service linked to Your account.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security, unauthorized access, or unauthorized use of Your account.

You may not use as a username the name of another person or entity, a name that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene. The Company reserves the right, in its sole discretion, to refuse registration of, or cancel, any username or account that breaches these provisions.

Intellectual Property

The Service and its original content, features, and functionality, including but not limited to all text, graphics, logos, images, audio clips, video, data compilations, and software (excluding User-Generated Content as defined below), are and will remain the exclusive property of the Company and its licensors. This includes content licensed from third-party providers like Pixabay, Pexels, Unsplash, and Original Equipment Manufacturers (OEMs).

The Service is protected by copyright, trademark, and other laws of both the Country (India) and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

User-Generated Content

The Service may allow You to post, link, store, share, and otherwise make available certain information, text, graphics, images, videos, audio, or other material (“User-Generated Content”) through features such as product reviews, ratings, customer testimonials, blog comments, photos, and videos. You are solely responsible for the User-Generated Content that You post on or through the Service, including its legality, reliability, and appropriateness.

By posting User-Generated Content on or through the Service, You grant to the Company a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User-Generated Content throughout the world in any media, for any purpose, without compensation to You. This includes, but is not limited to, displaying such content on the Website, in marketing materials, or on social media platforms.

You represent and warrant that: (i) You own or otherwise control all of the rights to the User-Generated Content that You post; (ii) the User-Generated Content is accurate and not misleading; and (iii) the use of Your User-Generated Content by the Company will not infringe upon or violate the rights of any third party, or any applicable laws or regulations.

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your Account or Your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. This includes, but is not limited to, suspected fraudulent activity, unauthorized or illegal transactions, or any other activity deemed harmful to the Service or its users.

Upon termination of Your Account or access, Your right to use the Service will cease immediately.

User-Initiated Account Termination and Data Removal

If You wish to terminate Your Account and request the removal of Your associated data, You may do so by submitting a formal request via email to our support team at contact@nachwanicycles.com. We will process Your request in accordance with our Privacy Policy and all applicable data protection laws.

Limitation of Liability

To the maximum extent permitted by applicable law, including but not limited to the laws of the Republic of India and the Consumer Protection Act, 2019, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by You through the Service for the Goods or Services in question. In cases where no purchase has been made (i.e., no amount was paid by You through the Service), the Company’s total aggregate liability shall be limited to a maximum of INR 1,000/- (Indian Rupees One Thousand Only), or the minimum amount permitted by the laws of the Republic of India, whichever is higher.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Product Liability & Manufacturer Warranties

The Company operates solely as a reseller and retailer of products manufactured by third parties. We are not the manufacturer of the Goods sold on the Service. Our liability for any defects in the Goods, or for any personal injury or property damage alleged to be arising directly from the use of such Goods, is limited to facilitating manufacturer warranties where applicable, as expressly provided on the respective product pages. Any claims regarding product defects or related liabilities should primarily be directed to the respective manufacturer, subject to their warranty terms and applicable Indian laws.

Some provisions within these Terms regarding the exclusion or limitation of implied warranties or liability for incidental or consequential damages may not be fully applicable in all circumstances under the laws of the Republic of India. In such cases, the Company’s liability will be limited to the greatest extent enforceable under the laws of the Republic of India.

Disclaimer of Warranties

The Service (meaning the website `nachwanicycles.com`) is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the Company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Product & Service Warranties

For Goods (Bicycles, Tricycles, Ride-ons, and Accessories): The Company operates as a reseller of products manufactured by third parties. Any express or implied warranties for the Goods sold through the Service are provided solely by the original manufacturer, not by the Company. Details of such manufacturer warranties, if any, will be specified on the respective product pages. The Company’s role is limited to facilitating valid manufacturer warranty claims where applicable, as per the manufacturer’s terms and conditions.

For Bicycle Repair Service: The Company provides a limited warranty on its bicycle repair services for a period of 7 (seven) days from the date of completion of the repair work. This warranty specifically covers the quality of the repair work performed and the parts replaced by the Company during that service. This warranty does not cover issues arising from subsequent misuse, accidental damage, normal wear and tear, modifications made by third parties, or repairs performed by others after our service.

The exclusions and limitations set forth in this “Disclaimer of Warranties” section are subject to the maximum extent permitted by applicable law, including but not limited to the laws of the Republic of India and the Consumer Protection Act, 2019. Some provisions within these Terms may not be fully applicable in all circumstances under Indian law, including those relating to mandatory statutory rights of a consumer regarding implied warranties. In such cases, the Company’s liability will be limited to the greatest extent enforceable under the laws of the Republic of India.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, Goods, or these Terms, You agree to first try to resolve the dispute informally by contacting the Company through any of the following methods:

Should an informal resolution not be possible within a reasonable timeframe, any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be finally settled by binding arbitration. The arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996, or any statutory modification or re-enactment thereof.

The place of arbitration shall be Yavatmal, Maharashtra, India. The arbitration proceedings shall be conducted in the English language. The decision of the arbitrator(s) shall be final and binding on both parties.

Subject to the above arbitration clause, You and the Company agree to submit to the exclusive jurisdiction of the courts located in Yavatmal, Maharashtra, India, for the resolution of any legal actions or proceedings arising out of or related to these Terms or the Service.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
